Attempted Murder, Aggravated Assault and Assault with a Deadly Weapon (ADW)

       According to police and prosecution documents and witness testimony, the following events occurred in and around Halifax, Nova Scotia.
       In August 2007, Alan Bryan attacked his pregnant girlfriend Charlene Knapp with a sword. She was found with multiple stab wounds and her three-month preborn baby died as a result of the attack. She suffered through four operations in a Halifax hospital after the assault.
       Police arrested Bryan and charged him with attempted murder, aggravated assault and assault with a sword. Because of Canada's total lack of abortion law, police could not charge him with any crime associated with the death of Charlene's wanted preborn baby. In fact, repeated attempts by pro-life Members of Parliament that would recognize both victims have failed after Canadian pro-abortion groups complained.
       Brian Rushfeldt, executive director of the Canadian Family Action Coalition, told the Toronto Sun that "You're killing one life, but you're not killing the other because it is not considered a human being. To me, this highlights the essence of recognizing life. Either we respect life or we don't, and I believe we should be recognizing the life of the unborn child."

Negligence

       Henry Morgentaler's Halifax abortuary was found liable for negligence in December of 1997 because it failed to provide a patient with adequate care after a 1993 abortion. The franchise was assessed damages of more than $700,000. Justice Douglas MacLellan found that although the client was "emotionally very shaky" and in pain, she was permitted to drive away from the abortuary within 30 to 45 minutes. He said the emotional turmoil resulting from the abortion caused her to faint, and then swerve into oncoming traffic. Justice MacLellan ruled the abortuary failed to protect the woman from harm by permitting her to drive off so soon after the abortion.
